Can appellant go for reinstating his job in parent company ?

My Case profile is as under - Appellant - Working as Officer in General Insurance Company -Central Govt Undertaking Resigned on dt April 2012 Conduct Disciplinary Action Against Appellant started May 2012 In between 2012,2013,2014 Appellant got several jobs in central and state jobs but was not able to join because of absence of relieving letter from previous employer. In Jan 2015 Head Office refused to impose penalty on appellant because it does not find sufficient facts by Regional Office Inquiry Committee to impose proposed penalty. In Feb 2015 Regional Office Accepted Resignation submitted April 2012 and relieved employee on Feb 2015. Now appellant is unemployed due to delay in CDA proceedings. Query - Can appellant go for reinstating his job in parent company. Fund settlement still not done till date. Pension deduction has not been settled.
