Is it necessary to receive original copy of complaint or FIR

13-Jun-2023 (In Family Law)
A FIR has been launched by my wife near PS. I have received a call from the PS for appearing before them. I went to the PS today and I was verbally told by the Investigation Officer(IO) that a case has been filed under section 498A, 504 and 506 of IPC, but they have not shown me the FIR copy. Question: Is it obligatory/ mandatory for the IO to show me the physical copy of the complaint/ FIR.

Your wife must have filed a complaint against you and in such cases FIR is not lodged directly. you would be called to Women's Cell for counselling and to mutually finish the matter. in case the police finds out any merit or you do not appear before the CAW cell then FIR shall be lodged against you. IN that case you will have to apply for Anticipatory bail and then you shall be given a copy of FIR.

IN case the FIR is already been lodged then you can get it online through your state police website.

Yes its your right to ask for copy of FIR. And as per new case ruling of Hon'ble Supreme Court Police have to varify certain things before arriving at a conclusion or decision to arrest and taking further action U/ s 498A.
