How to deal with brother forcefully taking over property

My elder brother has forcibly taken over a plot of 3000 sq. ft. after the death of father. What can I do legally against this action? Please suggest.

If this plot belonged to your dad, it should have come one half each, in your favour and in favor of your brother. File a suit for partition and possession in the competent civil court having jurisdiction.

Sorry to hear that this has happened. Technically as per devolution principals all heirs are supposed to get equal share of all properties. I suggest that you file a complaint with the police along with filing an appropriate suit against your brother. But remember resolution in such cases can take a while before a conclusion is reached.
