Transfer of flat name to my mothers name from uncles name.

Hi, the flat which we are staying in mumbai that flat my grandfather has purchased and it is now on my real cousin uncle name which he has transfer unknowly to my grandmother n now she is no more many years ago.Now flat is on his name but in this flat we are staying since more than 12 yrs but on flat n electric bill his name is there. Now my question is how can we can make this flat on my mother name ,we are having only ration card with us. When we are telling to him to transfer flat on our name he is refusing. What 2 do.??/ Pls help
Your Uncle can transfer the said property by mutation along with a Relinquishment Deed in favour of your mother with the consent of the concerned legal hiers. Kindly hire an advocate for this service as it takes time and money for the registration.
