wife not ready to live with me, in laws threatening us of court &498;

wife was doing a good private job at her parents city & pursuing her post graduation(part time).after marriage she told me she need time to complete her PG so she will live wid her parents.After 7 months of marriage she completed her PG & then resigned from the private job.then i took her with me here in delhi,after 20-25 days her parent called me to send her back as they are missing her, i told them its hardly 1 month completed and suggested them to visit her at delhi, but they refused. when she went to celebrate rakhi at her home she refused to come back to delhi & her parents threatening me. What to do?

Dear Sir,

You should file a restitution of conjugal right under section 9 of the Hindu Marriage Act.

The petition is filed by a party to marriage requring him or her to return back to the matrimonial relationship if she or he has left without any resonable cause.

I would like to inform you that in the event when either of the spouse withdraws himself or herself from the company of the other spouse without any readonsable reason . The court empowers the other spouse to avail protection of restoration of conjugal rights. In your present case it seems your wife has been unreasonable and indifferent towards her marital obligations in her wedlock with you. You can surely exercise that right to gain her company back from the court. The threaten from her parents could be because of their insecurity In leaving her

File for restitution of conjugal rights wherein u file a case in court saying that you were lawfully wdded to your wife and demand her to return to her matrimonial home. With regard to section 498a, these days courts have adopted very strict approach to such matters. Unless, the complainant substantiates her claim with sufficient proofs, she is likely to be defeated in a case u/s 498a. You should seek a lawyers advice in person. However, going by the looks of your query, it seems she wont have much proof on her.
