Me and my husband have joint name in the house .

I am hindu punjabi married to hindu punjabi boy in gurudwara in 1996. We have a son he is 18. My husband is having affair. We had fights and he beaten me because of this i staying with my mother along with my son. My husband is staying in our house which is jointly owned by me and him . I am the first owner. I was given share from my father's property. So we could purchase the house. I want to sell the house for which he is not agreeing what right do i have because. I am working as receptionist and my son is still studying. He never gave me money for my son.he just gave 15000 (jan 10000 and March 5000) uptil now.i had applied for mutual divorce in july 2015 but later we withdraw it because he didn't wanted to sell the house the termsand conditions mentioned in the petition was that we sell the house and take half share each after paying bank loan 10 lac and loan taken from my mother 2.5 lac but now he says he doesn't want to sell. Please guide me all this thing are affecting myson

You can sell your share in the flat and for handsome amount as you are in possession of the flat .You can get a purchaser.
There after you can ask for mainatainanace for your self and for son .
You can file divorce on grounds of cruelty .

You can take a formal order from the court of law for selling the said flat as well to get a formal divorce from him.
this case wont be a mutual divorce case. you will have to highlight all the problems created by him so far and then take order from the court to either delete his name from the said flat or take order to sell the said flat and take 50 % each. or may be 50% for you 20 % for your son and 30% for him. whatever you fell ok.
