How to apply for divorce

We have been married 4months ago. I can't stay with him anymore we don't have mutual understanding between us. I don't want to continue my life with him anymore. My mother in law is very strict she abuses my parents if she is bought this to her notice. What is the silent possible way I can apply for divorce ?

Hello,

You cannot file for divorce unless period of one year has elapsed from the date of marriage except in exceptional circumstances and if you feel that your case is an exceptional one and you are facing severe hardships, you may file an application u/s 14 of Hindu Marriage Act,1955 along with your divorce petition and try your luck. You may need to present your case very strongly in order to convince the court to allow your petition. Feel free to contact me with any doubts you may have for better clarification.

In general , you can apply for divorce only after 1 year from the date of marriage.
In exceptional circumstances, you can file for leave of appeal under section 14 of hindu marriage act and request the court to admit the divorce petition before completion of 1 year of marriage.
You can file for divorce either at the place where marriage was held or at your parent's place.
