How qualified wife can sit idle and also be eligible for maintenance

wife filed below cases against me Missing complaint on Nov 2014 - Closed Dowry case – Dec-2015 section 504,498,34 IPC 506 DV case –Dec 2015 Maintenance case in family court and even maintenance requested in DV case After all above Cases I have filed Divorce case. Presently only Divorce filed by me and maintenance case filed by her is completed by 50% and present status is court ordered interim maintenance to her 4000 and 3000 to child and in divorce case my crossing over next date marking of my evidence are there 1. How court passed interim when my wife is MSC graduate 7yrs experince
There are a couple of citations wherein women who are capable of earning are not entitled to maintenance. you can also check out various legal websites and blogs that provide caselaws in support of your case. so far as the child is concerned you will have to pay as a part of your responsibility.

More than 5 lakhs of husband asking same question from court ,many even has gone upto supreme Court, few were lucky that little relief they got( in ten years only 6 or so cases ), but who contested at trial court with merit they could reduce some . As per court maintenance is constitutional rights( though it is only obligatory) of wife hence it cannot be denied at all.What you read as Law is only for book .For any more information you may contact our senior .OFC : Pankaj Kumar ,Advocate

As far as child is concerned both are liable to maintain, further if your wife is earning but if it is not sufficient to maintain herself then in the standard of living which you are enjoying then court will order maintenance accordingly.
