Information about 482 Crpc and ways to challenge challan

02-Sep-2023 (In Criminal Law)
Respected sir, I would like to know about Section 482 cprc. Actually, the problem is police have removed all the accused apart from husband from the challan it has represented in the court. My lawyer suggested me to file 482 in the Punjab and Chandigarh High Court for challenging the challan . Sir, do reinvestigation really occur in an unbiased way , if the court decides ? Sir, further I would like to ask whether I can put Section 482 Crpc after the challan is presented in the Session Court OR do I have to file it earlier than challan filed in session court or i may file afterwards also

SIR,

AS FAR AS THE 482 IN HIGH COURT IS CONCERNED, YOU HAVE TO BE VERY VERY VIGILANT AS IN CASE HIGH COURT DISMISS YOU 482 PETITION THAN IN THAT EVENTUALITY YOU WILL NOT GET ANY RELIEF IN MAGISTRATE COURT AS WELL AS IN SESSIONS COURT.

KINDLY DONT RUSH TO HIGH COURT AS IN CASE YOU HAVE A GOOD CASE IN CHALLAN AND 482 GETS DISMISSED BY ANY REASON IT WILL BE HARMFUL FOR YOUR TRIAL.

KINDLY FIX AN APPOINTMENT IN CASE YOU WANT LEGAL ADVICE

Hi,
You should ask from the police why you have not putted the allegations or chargesheeted, if you have the sufficient evidence against the accused then you should give them with an application to the S.P, D.S.P or C.P for further investigation and if they have submitted the chargesheet or challan then the I.O on your request can ask from the court under 173 (8) crpc for further investigation and even section 319 crpc can also be helpful and if you want to seek the help from 482 then, it is upon the high court and thier is an inherent power of high court.
Thanks
