If builder refuse to pay amount for the flat back what to do

I had booked a flat on August 2015 on a pre-launch project, for flat 666...and made 100% payment regarding it..the project suppose to start by last year, but till now they not even started it..and informed me that allotment for flat 006 can't be done and will replace to other flat on the same project. I am not all interested with their services and the project offered, as they not even fulfilled any services. Can I be able to request for refund of 100% I have done...if they resist to pay what would be my next procedure to claim the amounts...???? Please advise.

Dear Sir/Madam, you have every right to get refund the amount from the builder/developer which you have paid to them and its all terms and conditions of the agreement between you and the said builder/developer, if you want refund the money you have to issued a legal notice through lawyer for the same, if they have failed to comply the demand legal notice thereafter you have to file petition before district consumer forum, you have good case on merit as per your query. If you want my legal service in this regard I will do it.

Yours is a good case. Firstly you pay prefer serving a legal notice on the builder stating the facts rightly and demanding refund and compensation. If the builder is unwilling to comply, you may prefer a complaint in the consumer court.

Hope you have all the papers for your transactions with the builder.
