How to file a case in consumer court against my builder?

I bought a flat in Hyderabad. Builder is a friend of my friend. he asked me to pay the money to his friends account. I did bank transfer to his friends account . the flat got registered on My name and i got OC also. He is not allocated car parking yet. After 2 months he and his friend got issues and now he is asking me pay it again since his friend is not paid to him. Could you guys let me know what are the options i have to fight back?. How can i fight to get car parking?

File one police complaint against him and his friend at your jurisdictional police station for cheating and breach of trust. Meanwhile go through the sale deed terms and conditions and what is the owner's liability when he fails to provide the amenities and file one complaint before consumer forum regarding this. Consult any advocate to proceed further.

First and foremost whether the builder had agreed to give you a car parking by way of any written agreement. At least during the execution of the sale deed whether a car parking is mentioned in the Schedule which you may please verify. If it is there or otherwise you can file a complaint under section 12 of the Consumer Protection Act against the builder before the Dist.Consumer Disputes REdressal Forum in Hyderabad for necessary relief. However, you can file it within two years and if the dispute is beyond limitation you have file an application for condonation of delay. Plenty of draft complaints are available in websites.
