Hospitals charging different rate for the same service is justified

Is it justified that leading hospitals like Fortis charge the same service (e.g. X ray) differently to different customers depending on the type of room they have bought? Can a PIL be filed for this?

Artcle 226, gives you wide power to approach against the violation of fundamental Rights. The hospital service is a public service and one can approach, irrespective of the fact that whether it is gov institute or not. But mark my words, this all demands for a very good ground prep and at the same time sound drafting and might be a senior lawyer.

Hospitals cannot charge more than the prescribed amount and usually that amount is supposed to be same for each patient.
If you suspect that patients are being charged differently, you may obtain such bills and information from the hospital by filling an RTI and then file a complaint in the consumer court.

if the hospital is charging differently for same service then there can be consumer complaint. But first check if they have displayed rates anywhere in there hospital. If they charge beyond that then complaint. They have right to give discounts to some also.
