Builder sold Flat sold to multiple customer,no documents for loan

Hi, I have booked a flat in New Panvel (Adai village) in 2012 while construction was supposed to start. That time builder promised me in next 3 months he would arrange all the necessary clearance documents i.e. N.A., Collector approval, CC, OC etc. So, I paid him Rs 3.40 Lakh against the total price of Rs 12.50 Lakh. Almost 2 years back building has completed & people start living there. But I haven’t taken the possession of flat because no nationalized bank is ready to approve loan on building due to non-availability of necessary clearance documents. Now the builder neither returning my amount nor I can sell the flat due to loan is not being sectioned on building. Also, I heard that the builder had sold that flat to someone else. Please suggest me where I could file the RTI to know about, on which name the flat has registered. And how could I approach the consumer court for recovering my money with interest till date. Hello with referring your query it seems that you purchased illegal flat , with the above mentioned query you can file complaint of forgery And you cN also file Pvt. criminal complaint under MOFA and that will have good chances of success and for further advise full details and documents are required. filing RTI does not make sense as it is not going to help your grievance moreover the amount paid by you was in cheque or cash or some other source? did builder approach you after collecting money from you? do you have papers or documents of the said flat? if yes then you can approach consumer court and claim compensation against the builder.

Obtaining all clearances is mandatory for builder irrespective of contract. Have you ever demanded necessary clearances (for loan approval) from builder and agreed schedule of payment of consideration are not known. Whether flat is sold can't be known under RTI. You have to make search in registrar office.
