What to do when accused is not adhering to court order ?

I had supplied material against which I was supposed to get the payment. Party denied the payment but after 1yr he gave me chq along the notarized MOU regarding the chq mentioning the chq will be cleared. But the cgq was returned with the mark if drawer stopped the payment. I filed a case u/s 138 but I think it is not working as he had orally promised me in front if the court that he will pay 25000/- every month but since last 3 months he has paid nothing. Pl advise me can I lodge FIR in the police u/s 420 406. Does not adhering the MOU leads to breach if contract. Pl advise at the earliest. Regards Chari

AS you have already filed a case under section 138 you can approach the court and inform/ intimate the court that the accused is not following the MOU and has not made the payment till date the procedure under the act to start again and the accused be summoned and the court may take necessary action against them,
