Issued cheque before now accounts are closed due to his death

My father issued empty signed promissory note & a blank cheque to a person and did not mention the date . my father died on 15 July 2015. We went to bank and ask the bank to close the account. The bank first stopped all the previously issued cheques and closed the account. There is no property in the name of my father (only nano car via a loan from tata motor finance on 17 nov 2012 for 5years tenure) Now what will happen if the person deposit the cheque and want to initiate a legal action .Given the fact that cheques are stopped and the account had been closed. He died 6 months ago.

The validity of cheque is 3 months. So if that period has passed then you do not require to do any thing. Even otherwise if he  deposits the cheque no action can be taken against your father , since he has expired.  As you mentioned that you have asked the bank to close the bank account, so any which pay the bank cannot make the payment. If at all he sends the legal notice, you can reply back the same and resolve the issue amicably
