Will of 84yr old bedridden mother

16-Jan-2023 (In Wills / Trusts Law)
My mother who is 84 yr old (Hindu) now suffered stroke attack few years back due to which she is bedridden & not able to sign. There is a self acquired property owned by her. Now, my elder brother is pressurising her to execute a registered WILL giving him major share in the said property. What's the validity of will considering the illness? What steps should I take to stop him for making will? What documents should I collect?

Will can only be executed after the death of the testator. However if the Will has been signed under pressure or unsoundness of mind or with illness, the same is void as per law. For any further legal assistance please feel free to contact

Thanks

Hi. See you cannot stop your mother from making a Will. That’s her right and prerogative. The right that exists with you is to challenge the Will as and when it surfaces. In the meanwhile to show her physical and mental health, start collecting medical records which will disclose the same.
