Will for Father who is in advanced Alzheimer (Mother Died)
06-Jan-2025 (In Wills / Trusts Law)
Dear Sir,
We are a Family of 3 ( 1 Sister + 2 Brother). Our mother dies 2 years back and father is currently battling advanced stage of Alzheimer. However there is No Will and hence we are not able to manage their Bank Accounts / FD / Properties etc. As per law what is the way to take get this Will made?
A will can be made of any living person. Since your father is under medical condition, it will be proper to get a doctors advise as to in what condition can he be considered sane to execute a legal document. Along with couple of witnesses, who can be close friends or family relatives, a Will can be made as per his wish of his assets and properties.
The Will, once executed, will come into effect only after the death of the person (testator). There is one executor assigned in the Will- who can be any person of the choice of the testator, whose responsibility is to execute the Will after the death of the testator.
First of all in order to make his will he should be capable of understanding it and signing as one of the requisites for the Will to be valid is that the person who is making it shall be of sound mind and fully aware of the same.
So if your father if medically fit then in that case we can make Will and get the same registered in order to avoid any future encumbrances.
For any further assistance please feel free to contact.
we need to understand the exact situation, whether he is able to understand things or not, speak or not, listen or not!
if he is currently fine, things can be managed to get the WILL done or take POA from him
atleast you will have protection fir future and may help you to manage his properties and assets
