Problem with the last will and testament of Mr. Ratial Vallabjee Vora.

My late father died with a will that was not registered? Can this be a problem for the executor? Can a rental property be willed to just one of the heirs by my father?

Dear Querist,
Registration of Will is not compulsory. It wont be a problem for executor. How can rental property be bequeathed.
But a testator can bequeathed a property to one of legal heir.
In that case, you should take certification of will from the appropriate Court.

Hello,

Please let me know if the will was signed by the 2 attesting witness or the testator. Even unregistered will can be valid if it is signed. Else you will need file a probate in local court. Once the relevant document and formality is complied with you shall have the relief granted. Please tell us if the property belonged to you or was taken on rent.
