Disinheritance of second wife from will

I am a father of two kids . I had them from my first wife who’s no more . I got married again but she turned out to be evil and married me for money . She has separated me from seeing my kids and she along with her family mentally tortured me .I can’t divorce as she won’t sign . I am thinking of creating a will wherein I want to mention her out from all rights over my property and all goes to my kids . Any advice regarding which she won’t be able to challenge my will in the future after my death

hello client as a matter of fact which you have fact in your above query about your second wife what she have done with you an dyour childrens in this matter you do not worry . in your matter yo do not worry as well as you can also divorce your wife as well do not worry at all regarding your childrens they will get there part of share in your property kindly call me

Hello Sir, You may make a Will in terms of your wishes, bequeathing all of your estate in favour of your two kids. FYI A lady involved in Divorce Proceedings could only claim interim maintenance and permanent alimony. Taking help of a professional lawyer for writing a Will is suggested.

From the facts mentioned in your query, as long as the said property is a self acquired property there shouldn't be an issue with respect to drafting of a bill as per your wish. As an alternative you may also consider transferring the property via a gift deed so there wouldn't be any issue in future.

And if there's no scope of living together and there is a presumption that she will not sign for divorce then rather stretching the relationship you should file for a contested divorce under the ground of cruelty. As far as the will is concerned you can get it registered with the registrar according to your jurisdiction so that no one can challenge it in future. For more legal assistance I am just a call away.
