Written book for a publisher not received payment had oral contract

Sir, i have written 3 books for publication ,they have also published the books. Now they are not clearing my Invoice of Rs.78000. We have gone through a verbal contract. I have some evidence against them. I have a watsapp chat records and sms record of their confession . What should i do to file a case ?

At the first instance you should send a legal notice asking them to clear your invoice at the earliest. Thereafter if they still do not clear the invoice then you can consider taking further legal action

You can file a suit for the performance for your contract, you can file a case in civil court demanding the above some. The conduct of the other parties in form of mail trail and invoice raised in your favour are sufficiently allowing you to make your case. Please consult a local lawyer.

You will have to send them a legal notice for recovery of outstanding dues, before you approach the Court to file a money suit against the defaulters. In the alternative you can also prefer a criminal/complaint against the defaulters complaining that you have been duped and defrauded your share of revenue/royalty in lieu of the books. The intellectual property right laws in India recognize performer's right and the framework of law is very sound to protect your interest
