First, do not ignore the summons. Non-appearance after service of summons can eventually lead to coercive steps including issuance of warrant depending upon the stage of proceedings and Court satisfaction. However, if you have genuine hardship, medical, financial or distance-related difficulty, you may: • File a proper exemption application seeking temporary personal appearance exemption • Raise your limitation and maintainability objections through appropriate written application • Place OTS/settlement communications on record • Seek permission for representation through counsel wherever legally permissible Merely sending emails or WhatsApp messages may not sufficiently protect your legal rights unless proper applications are filed before the Court in the prescribed manner. If limitation delay actually exists, that can be a strong legal defence, but it must be argued technically with dates, documents and statutory provisions before the Court. Do not wait for NBW issuance. Take immediate procedural steps through proper legal representation or authorised appearance mechanism before the next hearing date.
