If the ₹2,00,000 principal and agreed interest are genuinely due, you should not send a “dummy” or fabricated notice. You can first issue a proper demand/legal notice based on the actual transaction and documents. Mention the date and purpose of the loan, principal amount, agreed interest (2.5%—clarify whether monthly or otherwise), payments if any, present outstanding amount, and a reasonable time to repay. The three blank cheques, promissory note and Aadhaar/identity proof can be referred to as supporting documents, but do not fill in or misuse blank cheques merely to create a cause of action. If the borrower fails to pay after notice, depending on the facts and limitation, you may consider a civil recovery proceeding and/or appropriate proceedings relating to the promissory note or cheque, subject to the legal requirements applicable to each. Preserve the original documents and proof of the loan/transfer carefully.

Do not send a “dummy notice.” If ₹2,00,000 is legally due, issue a proper legal demand notice after verifying the Promissory Note, agreed interest rate, date of transaction and limitation. A 3-year delay requires immediate limitation scrutiny, including any acknowledgment or part-payment that may extend/restart limitation. The three blank cheques should not be misused or presented without proper legal basis. If dishonoured, proceedings under Section 138 of the Negotiable Instruments Act may arise only when the statutory requirements are satisfied. The Promissory Note and transaction records should be relied upon for recovery, while the Aadhaar card is only identity evidence and does not itself prove the debt.
