Do not ignore the Court proceedings or assume that settlement discussions alone will automatically close the criminal case. If your advocate has advised appearance and bail before the next hearing, you should take that seriously because repeated absence can result in coercive steps, including issuance of warrant. At the same time, merely defaulting in loan repayment does not automatically constitute a criminal offence unless allegations of cheating, fraudulent intention or deception from the beginning are specifically made and supported. Immediately do the following: • Obtain certified copies/case details and verify the exact allegations under BNS Sections 316(2) and 318(4) • Attend Court through proper legal representation • Secure bail/protection if advised by counsel • Preserve all loan records, repayment history, chats and settlement communications • If settlement is possible, insist on written terms regarding withdrawal/closure of proceedings Do not rely only on verbal assurances from recovery agents or company representatives. Until the matter is formally closed before Court, continue to treat the proceedings seriously and comply with legal process.
