Recovery suit against foreigner

My sister, her husband and myself, all have foreign passports & live in different countries. They took from me about Rs.47 lakh from my indian NRO account to their NRO account in DELHI via TWO cheque for Rs.25 lakh & Rs.21 lakh +. Now I want to recover that amount. How can I do that? There is no written agreement or document. I live in NZ & they in UK. Thanks

Since the amount transferred is in India from the account operative in India, jurisdiction can be made out in India. Since qurist is living abroad a special power of attorney in the favour of the person in India known or an advocate will suffice requirements as to proper representation. A recovery suit will be filed as per law and they can be made party. In case the court wishes, their evidence will be done through a local commissioner appointed by the court and once a decree is passed it can be executed at the country they are living or reside or in India or at New Zeland.
