Recovery Of Remaining Rental Deposit Balance

I vacated a rented residential premises last week of January 2026 and the landlord has not refunded the full security deposit. A balance amount remains unpaid. The landlord has acknowledged in writing that the balance deposit is payable and has committed to refund it on specific timelines, but the amount has still not been credited. No reason or justification for withholding the balance has been provided despite multiple follow-ups by email. The landlord is currently residing in the USA and has a power of attorney holder in India. I would like guidance on the appropriate legal steps to recover the pending balance.

give them a legal notice to the power of attorney holder and to the landlord and ask for compensation, damages, interest along with return of your security deposit, if necessary give a criminal complaint for criminal breach of trust in the police station for the inquiry to get started against them you can also tell police to call them

Send a legal notice demanding refund within a specific time (usually 15–30 days). If no response, file a civil suit for recovery of money. In Maharashtra, disputes may be governed under the Maharashtra Rent Control Act, 1999. In general rental matters across India, provisions of the Transfer of Property Act, 1882 may apply.

Issue a legal notice to the landlord demanding refund of the balance security deposit within a specified time. If payment is still not made, you may file a civil suit for recovery with interest and costs against the landlord through his power-of-attorney holder in the competent court in India.
