First, what does the notice says does it call you upon to make the payments or does it invoke the clause of Arbitration? Second, you should reply to the notice as soon as possible stating your issues and contention whatsoever it may be to avoid arbitration process.

As an advocate, upon receiving an arbitration notice from Bajaj Finance for a personal loan default, your immediate steps should be: * Review the Notice Thoroughly: Carefully examine the arbitration notice. Understand the claims made, the outstanding amount, the date of default, and the appointed arbitrator (if any). Check for details regarding the arbitration agreement mentioned in your loan contract. * Gather All Documents: Collect all relevant documents, including your personal loan agreement with Bajaj Finance, payment receipts, bank statements, and any communication exchanged with Bajaj Finance regarding your financial difficulties. * Communicate with Bajaj Finance: While arbitration is initiated, it's still advisable to attempt communication with Bajaj Finance. Explain your genuine financial distress and explore options like a repayment plan restructuring or a temporary deferment. Provide evidence of your financial hardship. * Understand Your Rights: Familiarize yourself with the provisions of the Arbitration and Conciliation Act, 1996. You have the right to present your case, challenge the arbitrator's appointment if there are valid grounds, and seek an opportunity to be heard. * Prepare Your Defense/Response: If negotiations fail, prepare a detailed response to the arbitration notice. This should include an acknowledgment of the debt (if applicable), a clear explanation of your financial problems, and a proposal for a sustainable repayment schedule that you can realistically adhere to. You may also explore if there are any discrepancies in the calculations or terms. * Participate in Arbitration: Attend all arbitration proceedings diligently. Present your case clearly and concisely. If you feel unequipped, consider engaging legal counsel to represent you during the arbitration process. While the notice is from Bajaj Finance, the arbitrator will act as a neutral party to facilitate a resolution. Important Note: Do not ignore the arbitration notice. Ignoring it could lead to an ex-parte award against you, which can then be enforced by law. Engaging in the process is crucial to protect your interests.

Well, you need to file an appropriate reply to the Legal Notice which has been received by you! If your reply is legally strong, then, Bajaj finance may think to either give you option of Loan Structuring or to waive off your loan!

If you’ve received an arbitration notice from Bajaj Finance for non-payment of a personal loan, it’s important to respond within the given time to avoid an ex parte award. Depending on the situation, we can either negotiate a settlement or contest the claim legally. I’ll need to review the notice and your loan documents to advise you properly. Feel free to get in touch for further assistance.
