Received a lawyer notice on promissory note signed 10 years ago

12-Jul-2025 (In Recovery Law)
Hello, I have received a lawyer notice from a person with whom my father has signed a promissory note 10 years ago. My father has expired 7 years ago. Is the promissory note and lawyer notice valid? Between, I have inherited property from my father.

A promissory note is normally valid only for 3 years from the date it was payable, as per the Limitation Act. Since it is 10 years old and your father passed away 7 years ago. the claim appears time barred. But as you inherited property, they may still try to claim against it . Keep all documents ready and Consult a lawyer to reply to the lawyer notice through your advocate citing limitation and deny liability.

Unless you stand as guarantor to the outstanding amount taken by your father, you hold no obligation to clear it. Generally a promissory note is valid for a period of three years from the date of demand. As your father got expired, the promissory note became invalid. However it is important to deny all the contents by way of reply notice, otherwise he can file a case against you by misleading facts.
