Based on the facts stated, the mere fact that all the Consumer Fora have granted only refund with interest does not, by itself, bar you from approaching the Hon'ble Supreme Court under Article 136 of the Constitution. However, an SLP is not a regular appeal, and the Supreme Court interferes only where there is a substantial question of law, jurisdictional error, perversity, or failure to consider the principal relief claimed. If your primary relief was specifically pleaded, supported by evidence, and yet remained unadjudicated or was ignored without reasons by the District Commission, State Commission, NCDRC, and even in the Review proceedings, you may contend that there has been a failure to exercise jurisdiction and denial of effective adjudication. The maintainability and prospects of success of the SLP will ultimately depend upon the pleadings, prayers, findings recorded in the impugned orders, and the nature of the relief originally sought. A detailed examination of all the orders and case records is essential before advising on the merits of filing the SLP.
