Opposite party didn't appear in the court
03-Aug-2024 (In Recovery Law)
The opposite party didn't appear in the court even when I sent them the legal notice. Judge said that they will wait till 2 pm but still the opposite party didn't appear. Judge has given a next date, what am I supposed to do? Should I ask opposite party to appear in the court on the next date? Or anything else I need to do?
If your matter is of criminal nature then you can always issue warrants against the opposite party and if it's of civil nature then in that case the judge can ex-parte the opposite party and even strike off his/her to cross examination. You should submit proper evidence that despite service he/she is not coming to the court and avoiding the proceedings.
