Money Recovery for Widow Woman – Promissory Notes Not Repaid

01-Apr-2026 (In Recovery Law)
My aunt (a widow woman) has given money to a person on promissory notes. The borrower has taken money and signed the documents. Now he is not repaying the full amount and is asking for a partial settlement. This money is very important for us and we cannot accept any reduction. We want to recover the full amount legally. Kindly guide us on the best legal steps. Can we send a legal notice or file a recovery case? Also, since the lender is a widow, are there any benefits or support available?

On the basis of duly executed promissory notes, your claim is legally enforceable, and the borrower is bound to repay the entire amount as agreed. His request for partial settlement has no legal force unless voluntarily accepted by you. You should immediately issue a legal notice demanding full repayment within a stipulated time. If the borrower fails to comply, you are entitled to initiate a civil suit for recovery based on the promissory notes, which constitute strong documentary evidence. Additionally, if the promissory note satisfies legal requirements, you may consider filing a summary suit under Order XXXVII CPC, which provides a faster remedy by restricting the borrower’s right to defend unless permitted by the Court. If there is evidence of dishonest intention from the beginning, you may also explore criminal proceedings for cheating, subject to facts. The fact that the lender is a widow does not alter substantive rights but may be considered by the Court for sympathetic and expeditious handling. You are advised to proceed promptly to avoid limitation issues and secure full recovery through proper legal action.
