MONEY GIVEN TO COLLEAGUE NOT RETURNED

ALMOST A YEAR BACK, I HAD GIVEN SOME MONEY TO A COLLEAGUE FOR GETTING A GST APPEAL FILED ON BEHALF OF A CLIENT OF MINE. THE AMOUNT WAS 5 LAC RUPEES AND HE HAS SINCE THEN DISAPPEARED AND STOPPED RESPONDING TO MY CALLS AND MESSAGES TOO. I HAVE A CHAT HISTORY AND FOLLOW UP HISTORY WHERE HE HAS PROMISED TO RETURN THE MONEY BUT NOTHING HAS BEEN RETURNED YET.
First you can send a Legal Notice to him stating and warning him legally to return the money. In case he doesn’t respond to the same then you can file a suit for recovery of money in the court or law for the said amount along with damages.

First of all rather than going legally you should serve him/her a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. After that if he/she fails to give you a satisfactory reply then you can anytime file a recovery suit in the court to claim your money back along with compensations.

Since you have chat history and follow-ups as evidence of his acknowledgment and promise to return the money, this will support your case. Additionally, you may also explore criminal remedies under Section 420 IPC (cheating) and Section 406 IPC (criminal breach of trust), as there seems to be dishonest misappropriation. It is advisable to first send him a legal notice demanding the refund with interest and, if there is no response, proceed with appropriate legal action.
