Can I file order 37 cpc with only whatsapp messages(agreed to pay) and upi transactions without any written agreement or promissory note for loan non repayment

Yes, a summary suit under Order 37 CPC can be maintained even without a formal written loan agreement or promissory note, provided there is clear, written acknowledgment of debt. WhatsApp messages admitting liability or agreeing to repay, along with UPI/bank transaction records, constitute admissible electronic evidence under the Evidence Act, if properly proved. However, the court will strictly examine whether: The WhatsApp messages amount to an unconditional acknowledgment of a definite sum The UPI transactions establish a loan and debtor–creditor relationship There is no triable issue requiring a full-fledged trial If the admission is clear and unequivocal, the court may proceed under Order 37 CPC. If there is any ambiguity, the court may grant leave to defend or direct filing of a regular money recovery suit. Proper drafting and presentation of electronic evidence are crucial for success in Order 37 proceedings. ⚖️ Summary suits succeed on clarity of admission, not on volume of documents.

It is difficulty to prove a case based on WhatsApp chat but you can file a case for filing case and get him to court for trial and prove before the court by examing the person is possible kindly give me further details do you have any phone pay transaction and any other things

Yes. You can use those as evidence being an electronic evidence under the bharatiya sakshya adhiniyam 2023. However order 37 cpc cannot be invoked and only a money recovery suit under section 27 cpc can be filed apart from a criminal case for cheating and fraud
