Legal Advice for Recovery of ₹50,000 Hand Loan from Borrower/Surety

21-Sep-2026 (In Recovery Law)
I gave a ₹50,000 hand loan in January 2025 under a signed agreement, repayable within three months with agreed interest . The surety also signed and agreed to repay if the borrower failed to pay. The amount remains unpaid, and both are currently unresponsive. What legal action can I take to recover the outstanding amount from the borrower and/or surety? How much money i need to spend for recovering the same.

You may issue a legal notice to the borrower and surety demanding the principal with contractual interest. If unpaid, file a money-recovery suit against both, relying on the signed agreement and surety undertaking. Court fee and advocate fee depend on the claim amount

Since you have a signed loan agreement and a signed surety undertaking, you can issue a legal demand notice to both the borrower and surety and thereafter initiate appropriate recovery proceedings. The surety’s liability depends on the exact terms of the agreement. Please share the agreement to assess the claim, interest and likely recovery costs.

You need to tell me what documentary proof you have showing that the amount was given. the surety is equally liable as the borrower. Send a Legal Notice to both demanding repayment within 15 days. If they fail to respond, file a Civil Recovery Suit. Keep your transaction proofs ready.

You have a signed loan agreement and a written surety undertaking, which provides a strong basis for recovery. First issue a formal legal notice to the borrower and surety demanding payment of the principal, contractually agreed interest and applicable costs within a stipulated period. If they fail to comply, appropriate civil recovery proceedings may be initiated against the borrower and, subject to the terms of the surety agreement, the surety. Preserve the original agreement, payment proof and all communications. The exact court fee and litigation cost depend on the claim amount and jurisdiction.
