Issue in Money recovery from a friend, who tried to defraud too

30-May-2026 (In Recovery Law)
A friend is not returning my money. The details are there in a notary-acknowledged document. He even made his friend talk to me as his father over a call, who asked for more money. Police denied registering a complaint. The document gives him a timeline of September end, but he hasn't given me any monthly payment in last 18 months. What would our next steps & their cost be? Loan amount is 4.5 lakhs.

First of all rather than going legally you should serve him/her a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. After that if he/she fails to give you a satisfactory reply then you can anytime file a recovery suit in the court to claim your money back along with compensations.

Hi there, in this matter you can file a summary suit for quicker recovery of the money given to the friend. Police will deny registering the complaint as it is a civil matter of friendly loan. I'll need additional details as to the transaction to provide you with an appropriate strategy for recovery. It's advisable to contact me and provide requisite details to assist you better.

Based on the facts provided, you appear to have both civil and criminal remedies available. The notarized acknowledgment of debt is a strong piece of evidence for recovery of the Rs. 4.5 lakh amount. A legal notice can first be issued demanding payment, followed by a recovery suit if the amount is not returned. If there is evidence that the borrower induced you to part with money through false representations, including impersonation of his father through another person, a criminal complaint for cheating and related offences may also be considered.

First and foremost step will be to send a strong legal notice claiming the loan amount with appropriate interest if the person still fails to give it then we will file a suit for recovery of the loan amount
