I was made Signatory for sales tax matters without my knowledge

08-Dec-2023 (In Recovery Law)

I was made a signatory for sales tax matters while working in a pvt.ltd company. as DGM-HR. I never signed any sales tax related papers or dealt with it any time. I had left this company almost 3 years back. Now company is closed down and directors are absconding. I was called in the sales tax office and asked the where about of its directors and recorded my statements, took my signature. Since I did not take my spectacles I could not read the contents . I am retired person of 61 years. I had given a letter on 6-6-2014 stating I am no more with the company. what action I can take?

It is clear that whatever documents you had signed you had signed in the capacity of an employee of your company. If there are any sales tax liabilities of your company, you cannot be made liable only because you signed certain papers. The sales tax authorities cannot proceed against you because you were only an employee. I would advise that you cooperate with the authorities. Report to them whenever they call you and provide whatever document they need which is in your possession. However be careful while signing papers in their office from now on. Dear Sir,

Kindly meet in person along-with all relevant documents which are with you including the copy of the statement which you gave to the sale tax authority for detailed advice. Your resignation letter is the key element in this matter.

Thanks
