How to claim car damage compensation & rent amount from second party

I had given my commercial car to a person on contract basis with an a one year agreement that he will give me a fixed amount every month and all major and minor service cost of car will be borne by the rentee but unfortunitely he damaged some parts of car like side mirror and from back side bonut..he given back my car after 21 days and I came to know about the damage I requested to pay my fixed amount with the damage occurred he agreed but now he is not reponding my phone calls and messeges

Yes u can recover just issued a legal notice therefore file a suit for damages and calm whatever you want to recover according to the contract. Within the territorial jurisdiction of the court. Pls confirm

Your wordings in the contract are of much relevance. Kindly adhere to the wordings in the agreement. If the said clause is there, then you may give a legal notice to him, correct the car, and recover the same from rentee.

since you have made the rentee a party of contract which is enforceable by law despite of the fact it being oral or written, thus you can file the case against the rentee in consumer redressal forum or your local consumer court to which you will be granted compensation of more than your original amount, for breach of contract under section 74 Indian Contract Act 1860 of harm, mental agony and physical harm to the vehicle.

As per agreement entered between you and him, you first got serve him a detail legal notice through a advocate and after that you can file suit for recovery suit before competent court of law with interest.
