Home interior work getting delayed, Instead of lot of follow ups

22-Jan-2023 (In Recovery Law)
I have hired a interior designer for my 3BHK flat. We have signed an agreement of payment terms in which I have paid 80% (5.5 lakh) for the 60% of work completion. Work started in 1/week of Sep, Original delivery date was 1/Nov. Based on his delivery commitments I left my rental home, but due to incomplete work I am staying in another rental home. Now he send person for work just 4-5 days in a month, every time I ask for completion date he says in a week he deliver. Now 3 month has passed listening to his false commitments. He is not refunding the money also, saying he will do the work. How should I take legal action against him?

Hello you can send a legal notice to him as per the terms and conditions of the agreement signed between you and the interior designer and demand for the refund of the money for non executed work and compensation as damages for the delay causing you to pay additional rental amount based on the timelines as agreed in the agreement.
