Holiday Membership Refund Refused Despite No Services Used
15-Jul-2026 (In Recovery Law)
I purchased a holiday membership for ₹1,10,000 (₹40,000 via SBI Card and ₹70,000 via IDFC FIRST Bank). I requested cancellation within 24 hours due to alleged misrepresentation and have never used any booking or membership benefits. SBI chargeback succeeded, but IDFC chargeback and RBI Ombudsman complaint were rejected as a banking matter. The merchant still refuses cancellation or refund. Do I have a strong Consumer Commission case, and should I first send a legal notice?
Yes. Based on the facts stated, you appear to have a prima facie case for deficiency in service and unfair trade practice, particularly if you sought cancellation within 24 hours, never availed any membership benefits, and can establish misrepresentation. Issuing a detailed legal notice is advisable before initiating proceedings. If the merchant still refuses to refund, you may file a Consumer Complaint seeking refund, interest, compensation for mental agony, and litigation costs. Preserve all agreements, payment records, cancellation requests, and correspondence as evidence.
