We can understand your grief In order to obtain stay against RC, ypu will have to make grounds of discrepancies in calculations/ payments already made or any other grounds of appeal. Once the RC proceedings and such grounds are shared, we can discuss about stay.

I handle DRT matters including Section 17 SARFAESI applications, appeals before DRAT, and stay against recovery certificates where urgency and correct documentation matter. To proceed for stay you will need the RC copy, loan account details, demand notice and previous correspondence. Once reviewed, we can move for urgent interim relief to prevent further recovery action while the case is contested on merits. Share documents so we can assess grounds quickly and file without delay.

You can proceed for stay against the recovery certificate before the concerned Debt Recovery Tribunal / Debt Recovery Appellate Tribunal (DRT / DRAT) depending on the stage of your matter. If a Recovery Certificate has already been issued by DRT, you may file an application under Section 30 of the RDDBFI Act, 1993 before the Presiding Officer seeking stay of recovery proceedings initiated by the Recovery Officer. Along with the stay application, you should challenge the legality of the recovery certificate by pointing out defects such as non-service of summons, violation of principles of natural justice, incorrect calculation of dues, or settlement / OTS already proposed. If coercive steps like attachment or auction have started, an urgent interim stay can be sought showing irreparable loss.
