If the Cyber Crime Branch has placed a lien (freeze) of ₹3,00,000 on the bank account, it usually means the account is suspected to be connected with a cyber fraud transaction. The bank blocks the amount based on instructions from the police under investigation. Since your client’s account is in IDBI Bank, the following legal course of action can be advised: 1. First Ascertain the Reason for Lien The client should: Visit the branch of IDBI Bank. Ask for written details of the lien such as: Cyber complaint number Name of the police station / Cyber Cell Date of lien marking Amount frozen Usually this is done on the instructions of the Indian Cyber Crime Coordination Centre portal complaint or a police investigation. 2. File Representation to Cyber Crime Branch Send a written representation to the Cyber Crime Police Station stating: The account holder is a bona-fide person. The amount received is from legitimate business/personal transaction. The account holder has no involvement in any cyber fraud. Request removal of lien / defreezing of the account. Attach: Bank statement KYC documents Proof of transaction (invoice, agreement, etc.) 3. If Police Do Not Remove Lien Two legal remedies are available: A. Application before Magistrate File an application before the Jurisdictional Magistrate Court under Section 457 of the Code of Criminal Procedure for release of the frozen amount. B. Writ Petition in High Court File a Writ Petition for De-freezing of Bank Account before the Bombay High Court if the freeze is arbitrary or without proper notice. 4. Important Legal Points Police cannot freeze the entire account unnecessarily if only a specific amount is under suspicion. The account holder must be given an opportunity to explain the transaction. If the money is legitimate, courts usually order defreezing or partial release

To unfreeze a cyber cell lien, you must submit a formal application to the concerned Cyber Cell and Bank, providing proof of legitimate transactions. If they don't comply, file a petition in court as per the concerned provisions of law.

you need to know the number and mail ID of the investigating officer you will get it from your bank, then you need to check which layer your account is freezed, which transaction is used for freezing your account the amount of the transaction will be marked as the lein in your account, now what you will do is either you higher a lawyer who can visit the police station and get the details about the case, simply giving objection letter and letter to account defreeze won't work in general cases, and the amount on which lein is marked, will be given back to the complain and if you tell the police to do so, and police has powers to remove your name and account from the case, if they don't do it you need to file an application with the magistrate, and get the orders for account defreeze and lein removal

If the Cyber Crime Branch has placed a lien or debit freeze of ₹3,00,000 in your bank account, it usually means that the amount is suspected to be connected with an online fraud investigation. In such cases, the bank acts on the direction of the police or cyber cell and temporarily blocks the amount until verification is completed. The bank itself normally cannot remove the lien without instructions from the investigating authority. You should immediately submit a written representation to the concerned Cyber Crime Police Station explaining that the money in your account is genuine and not connected with any fraudulent activity. Attach supporting documents such as bank statement, transaction details, invoices, agreements, salary proof, or any documents showing the legitimate source of the funds. Request them to verify the transaction and issue a letter to the bank for removal of the lien. You may also approach the concerned bank branch of IDBI Bank and obtain details of the complaint or reference number under which the amount was frozen. With that reference number, you can follow up with the Cyber Crime Branch for clarification. If the authorities do not release the amount despite providing documents, you may file an appropriate application before the jurisdictional Magistrate under the provisions of the Code of Criminal Procedure, 1973 seeking directions for defreezing of the bank account. Courts can order release of the amount if the funds are found to be legitimate.
