Customer Non Payment of Dues against our sales of goods kindly advise

One of our customer is defaulting in his payment against our sales of goods on 28th Aug 2019 for the amount of Rs. 2,49,264/- (The customer is based in Chennai and is a new customer and we are based in Mumbai) Still he has not cleared the payment even after our continuous follow up he keeps depositing payments in between like 30,000/- sometime 5,000/- etc as on date we have 1,19,217/- pending from this customer of ours. He always assured us that he will pay within next month or within some days but he has repeatedly defaulted in his commitments. Last month we had mailed him that we are moving legally for payment recovery, at that time he deposited 30,000 and told us that he will pay off all the amount by Dec 2020 ending, we mailed him yesterday for payment, now we got a mail saying that he will pay by jan2021 He has given us manny such commitment and we don’t trust his commitments any more. We have all the conversations in emails and messages. Kindly advice

Dear sir
my expertise is in debt recovery matters this is my core of practice as per my suggestion 1st you have to send one legal notice to the party if they are not complied with the said notice thereafter you can file a case against him in Chennai court
without notice you cant proceed further

Whether your customer is a company or an individual ? If it is a private limited company you can send him a legal notice under bankruptcy and insolvency code wherein the company has to send you payment schedule upon failure you can approach to NCLT court. In case of individual client you can send them demand notice and later on file recovery case against him.
