Consequences of home loan and Mudra loan turning NPA in Indian Oversea

05-Jan-2026 (In Recovery Law)
I have defaulted on a home loan and a Mudra loan with Indian Overseas Bank, both secured by my house. If both accounts are classified as NPA, what is the legal recovery process, notices, and timeline under Indian law, and when can the bank take possession or auction the property?

if both of your accounts get NPA, you will get section 13(2) notice for sale of property through auction under sarfaesi act, and then section 14 order in the same act, then writ of possession will be issued, it will take at least 9-10 months for bank to take your possession

Once both loan accounts are classified as NPA, the bank will usually proceed under the SARFAESI Act, 2002 (since Indian Overseas Bank is a secured creditor). First, a demand notice under Section 13(2) is issued, giving 60 days to clear dues or raise objections. If unpaid, the bank may take symbolic possession under Section 13(4) of the secured house and issue a possession notice. Physical possession can be taken with the help of the District Magistrate under Section 14. After possession, the bank can proceed with valuation, sale notice (30 days), and auction. Parallelly, the bank may also file an OA before DRT for recovery. Generally, auction can occur within 4–8 months after NPA, subject to compliance and litigation.

Under the SARFAESI Act, the bank will issue a Section 13(2) notice giving you 60 days to clear dues. If you fail to pay, they will issue a possession notice and can later auction the property after a 30-day public notice. You have the legal right to challenge these proceedings before the Debt Recovery Tribunal (DRT) within 45 days of the possession notice.
