Cibil Issue for past 2 years for closed loan
13-Feb-2023 (In Recovery Law)
I had taken a personal loan of Rs. 5lakhs from leading private bank (hereafter referred as " the bank”) in the year 2015. The EMI of which is 11764/- per month spread across 60 installments. At the time of taking loan, the bank had collected all relevant documents to process the ECS mandate. However, due to some issue from the bank it could not be processed properly. I informed the bank about it and eventually on their suggestion I started paying my dues through bill desk online payment every month. Later after the new RBI regulations and due to the issue on ECS mandate, a moratorium was automatically applied on my loan account. I received an SMS (dt. May 09, 2020) that moratorium is applied on my personal loan. I immediately sent an email to the bank requesting them to cancel the moratorium as I was paying my EMIs regularly. I had paid all my installment as on July 4 2020 (60th EMI due paid) and requested for loan closure NOC. I had even called them multiple times to sort the issue.
In such a scenario, you can issue a legal notice to a bank stating to close the said loan following the due procedure and provide you with the required NOC, as the consequences will have to be faced by you and If the bank does not provide you with the above said then they will have to face the legal implications.

This is the case of absolute negligence and deficiency in service. If you have paid the dues on time then the civil score can not be disturbed. You can right a representation stating all your grievances to RBI or can directly more to appropriate forum. For any further legal assistance please feel free to contact
Thanks
