cheque bouncing charges levied unnecessarily I am already in debt

I had taken home loan from aavas financiers ltd. The first EMI was supposed to be deducted on 5th December 2020, but was not deducted even though sufficient money was present in my account. So they imposed charges of Rs 590 as cheque bouncing charges ,When I complaint about this issue to their customer care they said this
" We would like to inform you that EMI of 5th Dec’2020 got bounced with the received reason from your respective bank of “Refer to Drawer” and the charges debited from your respective bank not by Aavas, request you to visit in your respective bank."
When I called bank for this issue they said they did not receive any such request for the transaction.
And on 24th December 2020 an amount of Rs 590 was deducted from my account as cheque bouncing charge automatically.
After that they levied unnecessary late payment charge even though my second EMI was payed on 5th January automatically.
They are not initiating a refund. can I file a lawsuit for mental harassment
