You can certainly file a matter in Court. But your matter will lack evidence since the money was given in cash. You can put the cheques in the bank and in case the cheques bounce, a matter under section 138 of N I Act can be filed.

You can file a cheque Bounce case against him provided the cheque has not crossed more than 3 months since the date of the cheque.
