You may file a case against the builder before consumer forum and seek refunds along with interest from the date of the payments.
Though, it is not necessary to issue legal notice but if you want to exhaust that option before knocking the doors of the consumer court, you may issue one to see the reaction of the builder.
If builder do not refund or revert to notice then the only option would be to file case before consumer court.

You should file complaint to the police as builder has committed fraud by taking booking against a property which is not owned by him. Fir would be registered against him. You may also seek refund of money with damages by filing civil suit or consumer case. Better to engage an advocate to make case effective.

You have not provided the complete details
Whether the amount was paid by you in one go or what was the last date of payment made by you
whether any documents were executed at the time of entering into agreement or else what are the documents available with you to support your claim
what action / correspondence was taken / done by you during these years
accordingly you can take action against the builder in consumer court and claim refund & compensation , also you can file a criminal complaint against him.
