Bank Account Lien Due to Gaming Transaction – Need Legal Guidance

10-Sep-2025 (In Recovery Law)
Hi, I found one of my transactions on lien in my bank app. The bank said a cyber cell complaint was filed, possibly due to my use of an online gaming site. I used it only for entertainment and didn’t know if it was legal/illegal. Cyber cell gave me inspector contacts, but calls are unanswered. What steps should I take to remove the lien?

Since your account has been frozen/lien marked due to a cyber cell complaint, you should first write to the bank and cyber cell seeking official reasons. If no reply is received, the legal remedy is to file an application before the jurisdictional Magistrate under Section 497 of BNSS (equivalent to Sec. 451/457 CrPC) seeking release of the lien/frozen account. The court can direct the bank to lift the lien if there is no ongoing investigation or if the money is not case property. If needed, a writ petition in the High Court is also an option.

It appears that a lien has been marked on your account due to a cyber cell complaint linked to the transaction. Since it may relate to gaming transactions, you should immediately file a written representation with your bank seeking the exact reason and copy of the complaint. Simultaneously, approach the concerned Cyber Cell office in writing, enclosing bank communication, and request status of the complaint. If the police are not responding, you may escalate to senior officials or file an application before the court to seek clarity. For further information, you may contact me.

i advise you to give representation to the cyber cell first, they cannot seize the whole account, if there is suspicion they can seize that particular transaction that's it. Recently, one of the judgments of the Delhi High Court gave a clear view on this issue.
