What to do if the builder is not giving possession from past ten years

I have booked a plot in Wave city in 2005. They are asking excessive amount for taking over possession. Also not paying for delay in possession which is more than 10 years. Their attitude is kind of dictatorship.

You must file a complaint under new real estate law. You take help of an advocate for filing complaint. This forum is quite helpful and hopefully your problem will be resolved. You have right to get interest also in the delay period. The catch is that you have an experienced lawyer of real estate law.

In the above-mentioned query please file immediately a complaint under RERA act against the builder and annexe all the documents which supports the complaint. Within three months the complaint will be decided.

when You has book plot then builder give you booking letter or agreement and how much amount you paid. If builder not give you possession. You can complaint against them in rera and consumer forum also

You need to file a consumer complaint before the State Consumer commission if the value of flat is upto Rs. 1 crore and if exceeds 1 crore before the National Consumer Commission. You can also file complaint with RERA Tribunal but it is in its initial stage and may not be a proper fora for your redressal.

First give the builder a notice/legal notice for giving possession if you haven't given the notice in the past. Thereafter, if the builder doesn't respond to the notice by giving possession, then take legal action. If Builder is a company (private or public limited) then you can approach National Company Law Tribunal as a Financial Creditor. Otherwise, you can approach Real Estate Regulatory Authority.
