What to do if builder after taking money do not start constcution

Greetings. I bought one land and decided to construct the house building by engaging one builder. The advance amount IRS.5lacs was paid to the builder and it was agreed to complete the construction within 1 year. However the builder was not taking any actions and no construction related activities are started and 6 months already passed.I lost the confidence level with the builder and planning to get the money back from the builder Please advice what can be done?

Hi madam sir.
If you not interested mean send legal notice and cancel the agreement after they settle suppose he is not willing to settle mean you can file recovery of money suit

You can do two things, either both or one. File a cheating case against him. 2. File a consumer complaint stating all facts and asking him to return the money with loss and mental agony you suffered. You can file both csses simultaneously.

It is not clear if any written construction agreement has been executed by you with the builder. If so, it has to be scrutinized to see the default clause. You may send him a legal notice first demanding refund of the amount. If there be no positive response, you have to file a suit against the builder for specific performance.

If the builder doesn't start the work even after six months of initial advance payment, it is very difficult to complete the work in next six months. I just wanted to know, if u are entered into an any written agreement with the builder. Moreover you can very well claim the amount paid to him after a period of one year. Prior to that it is better to send legal notice explaining all your grievances and delay in starting the work including return of money with interest. If you need detailed advice, pl contact me.

sir,
you have the remedy by approaching the civil court by filing a suit for specific performance. you should submit the agreement copy before the court while filing the case. before this you have to issue a legal notice to the defaulting contractor.
