What is the procedure for change of title to property in papers

20-Feb-2023 (In Property Law)
My father bought home 25 years before and in property paper,he had given name of him and along with his 2 younger brothers. But none of my uncle's family residing in that home. And none of my uncle had given any money to buy or for construction of home. I want to know that are they eligible to get the share of land/home? Or is there any process to transfer the property from 3 name to my father name (who is real owner of home)?

Incorporation of a name entitles creation of share and right. Deletion of name can occur only with their consent. Else you will be required to file a title suit for the same making the seller and your uncle as parties too.

Respected Questioner,
As per you query, I would like to inform you that Indian Law permits two properties which would be devolve among legal heirs. (1) Ancestral Property (2) Self Acquired property. According to Ancestral Property Indian Law elaborates that this property shall be devolved among legal heirs automatically after the death of Owner but in Self Acquired Property, Law avers that it can not be transferred to legal heirs without permission of Owner. In your case if your father purchased without held of grandfather or using ancestral property then it is purely your father property and no one can claim except blood son and wife... As your father has registered the property 25 years ago ,in the process he had added or made two of urs uncle joint owner over that property. As per sucession right u have right over ur property .But in case there had been joint owner u could have to face legal court case if ur uncle reject urs claim. If u need u may consult me .
